Terms of Service

These Terms of Service (“Terms”) constitute a legally binding agreement between you and BlueberryBytes Services FZCO (“we,” “us,” or “our”) governing your access to and use of the Aurelmobile application and any related services (collectively, the “App”).

We reserve the right to modify these Terms at any time. We will notify you of material changes through the App or by other means. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.

You must be at least 13 years of age (16 in the EU/EEA) to use the App. By using the App, you represent and warrant that you meet this age requirement. If you are under the age of 18, you represent that your parent or guardian has reviewed and agreed to these Terms.

To access certain features of the App, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your login credentials confidential
• Notify us immediately of any unauthorized access to your account
• Be responsible for all activity that occurs under your account

We reserve the right to terminate accounts that violate these Terms or for any other reason at our discretion.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a device you own or control, solely for your personal, non-commercial purposes.

You may not:

• Copy, modify, or create derivative works of the App
• Reverse engineer, disassemble, or decompile the App
• Sell, rent, lease, or sublicense the App or access to it
• Use the App for any commercial purpose without our prior written consent
• Remove or alter any proprietary notices in the App
• Use automated means to access or scrape content from the App

5.1 Free and Premium Access

Aurel offers both free and premium subscription tiers. Certain features are available only with a paid subscription.

5.2 In-App Purchases

Premium subscriptions are purchased through the Apple App Store. Billing, payment processing, and refunds are governed by Apple’s terms and conditions. By purchasing a subscription, you also agree to Apple’s Terms of Service.

5.3 Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date. Your Apple ID account will be charged within 24 hours prior to the end of the current period.

5.4 Cancellation

You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. We do not provide refunds for unused portions of a subscription period.

5.5 Price Changes

We reserve the right to change subscription prices. We will provide reasonable notice of price changes. Continued use of the subscription after a price change takes effect constitutes acceptance of the new price.

The App allows you to create and store personal content such as diary entries, goals, and habit data (“User Content”). You retain ownership of your User Content.

By creating User Content, you grant us a limited license to store and process it solely for the purpose of providing the App’s features to you. We do not claim ownership of your User Content and do not sell it to third parties.

You are solely responsible for your User Content. You agree not to create content that:

• Violates any applicable law or regulation
• Infringes the intellectual property rights of any third party
• Contains malware, viruses, or harmful code

The App and all its content, features, and functionality — including but not limited to text, graphics, logos, icons, philosophical content, lesson materials, and software — are owned by BlueberryBytes Services FZCO or its licensors and are protected by copyright, trademark, and other intellectual property laws.

The philosophical quotes and writings from historical figures (Marcus Aurelius, Lao Tzu, Confucius, etc.) included in the App are in the public domain. Our original lesson content, commentary, structure, and presentation are our intellectual property.

You agree not to:

• Use the App in violation of any applicable law or regulation
• Attempt to gain unauthorized access to any part of the App or its systems
• Interfere with or disrupt the integrity or performance of the App
• Impersonate any person or entity
• Engage in data mining, scraping, or similar data extraction activities
• Use the App to transmit spam or unsolicited communications
• Circumvent or attempt to circumvent any content-filtering or access-restriction measures

THE APP IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Aurel provides philosophical and educational content for informational and personal development purposes only. The content is not intended as professional mental health, medical, legal, or financial advice. Always seek the advice of qualified professionals for specific concerns.

We do not guarantee that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BLUEBERRYBYTES SERVICES FZCO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE APP OR SUBSCRIPTION IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) USD 100.

Some jurisdictions do not allow the exclusion or limitation of liability for certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

You agree to defend, indemnify, and hold harmless BlueberryBytes Services FZCO and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.

The App may contain links to or integrations with third-party services (such as Apple App Store, Google, Facebook). We are not responsible for the content, privacy practices, or terms of these third-party services. Your use of third-party services is governed by their respective terms.

We may suspend or terminate your access to the App at any time, with or without cause or notice. Upon termination, your license to use the App immediately ceases. Provisions of these Terms that by their nature should survive termination shall survive (including sections on intellectual property, disclaimers, limitation of liability, and governing law).

You may terminate your account at any time by deleting it within the App (Settings → Account → Delete Account) or by contacting us.

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates and the laws of the Dubai International Financial Centre (DIFC), without regard to conflict of law principles.

Any dispute arising from these Terms or your use of the App shall first be attempted to be resolved through good-faith negotiations. If not resolved within 30 days, disputes shall be submitted to the exclusive jurisdiction of the courts of Dubai, UAE.

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BlueberryBytes Services FZCO regarding the App, and supersede all prior agreements and understandings.
